New in legislation 2018 On June 28, 2018, amendments made by Federal Law No. 463-FZ of December 29, 2017 to the Town Planning Code and Federal Law No. 131-FZ of October 6, 2003 came into force, resolving the question of who bears the costs of maintenance and improvement of the adjacent territory in the case when the land plot under and or adjacent to an apartment building is not formed and not put on cadastral registration?

If the land plot is formed and transferred as part of the common property, then the owners of the premises, as co-owners of the common property, must pay for its maintenance. If the land is municipally owned, the municipality must maintain it. The widespread practice of earlier imposing on tenants the burden of maintenance of some territory around the house that does not belong to them and is not part of the common property of the apartment building, has not found understanding in the prosecutor's office.
