If this person is of legal age, legal capacity, owns his share by right of ownership, if the share is not mortgaged and there are no obligations to pay loans, utility bills, etc., if he has no dependent minors or incapacitated, if he pays gift tax and if the other person gives a written, possibly notarized, consent, then he can.
