There's a good chance. If it doesn't turn the compressor off at all in the extreme position then the problem is the thermostat. It just stupidly shorted the circuit and it's flailing without shutting down. Are you sure you didn't mix up the contacts when you wired the thermostat? And the thermostat is not matched to the length of the capillary tube?

most likely the problem is in the tubes - I think there is a clog somewhere in the tube - most likely in the lower compartment - so the thermostat won't turn off - it tries to catch the temperature at the bottom but it all goes up

The thermostat is not set correctly. You want the tube to touch the evaporator not 1 cm but 10 or more. It is also possible that you have a freon leak which can be fixed with difficulty or not fixed at all. As far as reliability is concerned, this is not a very good model. You're in a lot of trouble.

If it flails and does not turn off and the ice is not in the freon but in the thermostat or does not stand right or not working.
